Approved Minutes of Peru Town Board’s July 22, 2019 Meeting

The regular meeting of the Peru Town Board was held on Monday, July 22, 2019 at the Peru Town Hall. Those present were Mr. Brandy McDonald Supervisor; Mr. James Douglass, Councilman; Mr. James Langley, Councilman; Mr. Melvin Irwin, Councilman; Mr. Richard Barber Jr., Councilman; Mr. Matthew Favro, Town Attorney; Mrs. Dianne Miller, Town Clerk. Also present Mr. Courtney Tetrault, Water/Sewer Superintendent; Mr. Michael Farrell, Highway Superintendent; Ms. Pamela Barber, Secretary to the Board and Mr. Dave Drollette, Dog Control Officer.

The meeting was called to order at 7:02 PM by Mr. McDonald, with the Pledge of Allegiance.

Motion by Mr. Langley; seconded by Mr. Irwin to approve the minutes from the July 8, 2019 meeting.

Community Input and Questions

Mr. Ryan asked for updates for Washington Street and Main Street Project. Mr. McDonald stated all issues are moving forward as the developer is cooperating and taking full responsibility for the unresolved issues. Main Street Project continues to be on hold.
Mr. Ryan asked about attendance at the Gazebo Concert Series. Ms. Barber replied very positive.

RESOLUTION NUMBER: 19.07.22-1

A RESOLUTION AUTHORIZING THE APPOINTMENT OF JEREMIAH CROSS AS APPOINTED ASSESSOR FOR A SIX YEAR TERM OF OFFICE BEGINNING OCTOBER 1, 2019.

MOTION: Mr. Langley SECOND: Mr. Barber

WHEREAS, the Real Property Tax Law 310 states that the term of office for sole assessor is a six year appointment which starts on October 1, 2019 and ending on September 31, 2025.

WHEREAS, the Town Board has reviewed the qualifications and performance of the proposed replacement Appointed Assessor, Jeremiah Cross and considers his reappointment to be of great benefit to the Town of Peru,

THEREFORE, BE IT
RESOLVED, that Jeremiah Cross is reappointed as the Assessor for the Town of Peru for a term beginning October 1, 2019 and ending September 30, 2025.

Declaring Highway Equipment as Surplus and Put Up for Auction

Motion by Mr. Langley seconded by Mr. Barber authorizing Mr. Farrell to advertise in Auction International the surplus 1998 International vehicle and 644 spare bucket.

RESOLUTION SETTING A PUBLIC HEARING AMENDING THE ZONING MAP OF THETOWN OF PERU, PURSUANT TO SECTION 801 OF THE TOWN’S ZONINGORDINANCE, NEW YORK MUNICIPAL HOME RULE LAW SECTION 10 AND NEW YORK TOWN LAW SECTION 261

WHEREAS, pursuant to Section 801 of the Zoning Law Town of Peru, the Zoning Map may be amended, supplemented, or repealed, from time to time, by the Town Board of the Town of Peru on its own motion; and

WHEREAS the Town Board wishes to amend the zoning map as recommended by the Town Planning Board and Town Zoning Board of Appeals, more specifically amending fourparcels from “COMMERCIAL” to “RESIDENTIAL,” as more clearly depicted on a map datedJune 11, 2019 attached hereto; and

NOW THEREFORE BE IT RESOLVED, by the Town Board of the Town of Peru, that a public hearing on the above proposed Zoning Map Amendment is hereby set for August 26, 2019 at 6:30 PM.

This Resolution shall take effect immediately and shall be dated July 22, 2019.

Dog Control of Surrounding Municipalities

Mr. Favro recommended inquiring with the Town’s insurance company the possible risk of Mr.Drollette working outside our municipality before any more discussion.

Court Roof Specifications for Bid

Motion by Mr. Langley seconded by Mr. Barber that the bid will be for labor only. Prevailing wages will apply.

Sewer Collection Update

Mr. Tetrault attended a meeting on site. The new line on Elm Street will be installed in the road opposite the sidewalk.

Other Business

Mr. Irwin thanked the highway crew on the support while Mr. Farrell was absent.
Mr. Gibbs informed Mr. Farrell a 10 x 3 culvert will be able to be used at the Patent Road.

7 applications will be reviewed by Mr. Gibbs for the August Planning Board Meeting as stated by Mr. Guynup.
