Justice Delayed Is Justice Denied – An Opinion by John Ryan

Peru – The accompanying photo depicts the scene at the January 15th Zoning Board of Appeals Meeting. The Board, an applicant seeking a use variance to start a new business, his attorney and several of his supporters were present. By law the Zoning Board should have five members; however a resignation resulted in it currently having only four members. As sometimes happens a Board member had a valid reason for not being present; therefore, an unanimous 3-0 vote would have been required for the variance’s approval. To almost no one’s surprise, the applicant and his attorney requested that the matter be delayed until the Board’s February 19th meeting.

Why is a complete Zoning Board important to you? The business and residential matters they consider oftentimes result in an expanded tax base and lower taxes for us all. New buildings are constructed and older buildings are renovated. Jobs are created. Our community becomes a better place to live. Very importantly, applicants deserve a timely hearing. As the saying goes, “Justice delayed is justice denied.”

The problem can easily solved. Smart, public spirited Peru residents must make time to serve on either the Zoning Board or the Planning Board. The “other” guy or gal is not going to volunteer. It’s up to you.

Applying is easy. Submit a letter of interest with a brief biography and your phone number to Planning/Zoning Board Secretary Darlene Grigware, Peru Town Hall, 3036 Main St. For more information call Darlene at 518-643-2745 Ext. 6 or email zoning secretary@perutown.com for information.

Sewage system upgrade explained to residents

Peru – On Monday, January 14, 2020 the Peru Town Board, Water/Sewer Superintendent Courtney Tetrault and AES Engineering representatives conducted an informational meeting on Peru’s planned $4.6 million sewage system upgrade. Approximately 11,000 feet of new sewage lines and two new pumping stations will be installed. Most of the current sewer pipes were installed almost 100 years ago. Some are in danger of collapsing. The Maiden Lane pump station is undersized. The system was not built to handle the Peru’s strong residential growth. Bids are expected be advertised within the next 60 days with work hopefully beginning this spring and completed by late fall.

Letters announcing the meeting were sent to residents directly impacted by work that will take place on or near their property. All sewer district users will be impacted by increased sewer rates. Supervisor Brandy McDonald said the increase for the average user would be $24 to $29 per month. The exact amount will not be known until bids come in. The project is being financed by a $1 million NYS grant and long-term (38-year) bonding.

Major Peru Projects Get A Go-Ahead

Proposed Maplefields

Proposed Maplefields

Gazette file photo of the Washington St. extension

By John T. Ryan

Peru – Two major development projects will hopefully move forward in 2020 following the Wednesday, January 8th Planning Board meeting.

Winter Lane LLC developers of the Orchard View subdivision on Washington Street received approval to move forward with its plans to develop 13 new homes southwest of the existing homes. Winter Lane must record its site survey with Clinton County Real Property within ninety days. At that point the property will be assessed on a lot by lot basis rather than as one parcel.

The Town of Peru has bonds in place attempting to ensure that Winter Lane complies with street pavement thickness, ditching, sidewalk and a turnaround requirements. The installed manhole covers are also too elevated and must be corrected. These issues have held up the Town’s acceptance of the road. The existing road is considered to be a private driveway that Winter Lane must maintain.

Codes Enforcement Officer Bob Guynup said NYS Department of Environment Conservation (DEC) and the U.S. Army Corp of Engineers also have compliance issues with the project. DEC is requiring that Winter Lane install an additional water retention basin. The current basin did not accommodate storm water runoff resulting in a few Washington Street basements being flooded. Clear-cutting the trees on the property also apparently violated U.S. Army Corp of Engineers regulations. Winter Lane representative Jim Abdallah of Architectural and Engineering Design Associates (AEDA) said Winter Lane is communicating with both agencies attempting to bring the project into compliance.

Constructing a new Maplefields store on the Bear Swamp Rd. is the other major project. Construction could begin as soon as March depending on the weather. Owner R.L. Vallee corrected a few Board concerns and the Board responded by giving its quick approval Wednesday night. The new store is expected to take about 90 days to construct. The business will be closed during construction.
