The organizational meeting of the Town of Peru, Town Board was held on January 14, 2019 at 6:30 PM, at the Peru Town Hall. Those present were Mr. Brandy McDonald, Supervisor; Mr. James Douglass, Councilman; Mr. Melvin Irwin, Councilman; Mr. Richard Barber, Councilman; and Mrs. Dianne Miller, Town Clerk.

RESOLUTION 19.01.14.10;
Approval of 2019 Town of Peru, Procurement Policy
WHEREAS, Section 104b of the General Municipal Law requires every town to adopt internal policies and procedures governing all procurement of goods and services not subject to the bidding requirements of the General Municipal Law or any other law; and
WHEREAS, comments have been solicited from those officers of the Town involved with procurement;
NOW THEREFORE BE IT RESOLVED that the Town of Peru does hereby adopt the following procurement policies and procedures:
Section 1. Every prospective purchase of goods or services shall be evaluated to determine the applicability of General Municipal Law. Every town officer, department head or other personnel with the requisite purchasing authority (hereinafter Purchaser) shall estimate the cumulative amount of the items of supply or equipment needed in a given fiscal year. That estimate shall include the canvass of other town departments and past history to determine the likely yearly value of the commodity to be acquired. The information gathered and conclusions reached shall be documented and kept with the file or other documentation supporting the purchase activity.
Section 2. All purchases of (a) supplies or equipment which exceed $20,000.00, in the fiscal year, or (b) public works contracts over $35,000.00 shall be formally bid pursuant to General Municipal Law Section 103.
Section 3. All estimated purchases of:
Greater than $10,000.00 but no more than $20,000.00 requires a written or faxed quote from three (3) vendors.
Greater than $1,000.00 but no more than 10,000.00 requires a written or faxed quote from two (2) vendors.
Any amount up to $1,000.00 is left to the discretion of the Purchaser.

All Estimated Public Works Contracts of:
Greater than $10,000.00 but no more than $35,000.00 requires a written or faxed quote from three (3) contractors.
Greater than $5,000.00 but no more than $10,000.00requires a written or faxed quote from two (2) contractors.

Any written request shall describe the desired goods, quantity and the particulars of deliver. The Purchaser shall compile a list of all vendors from whom written, or faxed quotes have been requested and the written, or faxed quotes.
All information gathered in complying with the procedures of this resolution shall be preserved and filed with the documentation supporting the subsequent purchase or public works contract.
Section 4. Notwithstanding the provisions of Section 2 herein, any purchase contracts (including contracts for service work, but excluding any purchase contracts necessary for the completion of a public works contract pursuant to article eight of the labor law) may be awarded on the basis of best value, as defined in section one hundred and sixty three of the state finance law, to a responsive and responsible bidder or offerer. Goods and services procured and awarded on the basis of best value are those that the Town Board determines will be of the highest quality while being the most cost efficient. The determination of quality and cost efficiency shall be based on objectively quantified and clearly described and documented criteria, which may include, but shall not be limited to, any or all of the following: cost of maintenance; proximity to the end user if distance or response time is a significant term; durability; availability of replacement parts or maintenance contractors; longer product life; product performance criteria and quality of craftsmanship.
Section 5. The Lowest responsible proposal or quote shall be awarded the purchase or public works contract unless the Purchaser prepares a written justification providing reasons why it is in the best interest of the Town and its taxpayers to make an award to other than the low bidder. If a bidder is not deemed responsible, facts supporting that judgment shall also be documented and filed with the record supporting the procurement.
Section 6. A good faith effort shall be made to obtain the required number of proposals or quotations. If the Purchaser unable to obtain the required number of proposals or quotations, the Purchaser shall document the attempt(s) made at obtaining the proposals. In no event shall the inability to obtain the proposals or quotes be a bar to the procurement.
Section 7. Except when directed by the Town Board, no solicitation or written proposals or quotations shall be required under the following circumstances:
Acquisition of professional services;
Emergencies (See Section 7);
Sole Source situations;
Goods purchased from agencies for the blind or severely handicapped;
Goods purchased from correctional facilities;
Goods purchased from other governmental agency;
Goods purchased at auctions;
Goods purchased for less than $1,000.00; and
Public Works Contract for less than $5,000.00

Items Not Subject to Competitive Bidding – For those items not subject to competitive bidding such as professional services, emergencies, purchases under State or County contracts or procurement from sole sources, documentation should include a memo to the files which details why the procurement is not subject to a competitive bidding and include
A description of the facts giving rise to the emergency and that they meet the statutory criteria;
A description of the professional services;
Copies of state or county contracts;
Opinions of municipal attorney;
A description of sole source items and how such determinations were made.

Community Input and Questions
Mr. Ryan asked for an update on Washington Street. Mr. Guynup stated Mr. Gibbs has evaluated the situation and a letter has been sent to Bill Sawyer. A meeting is going to be scheduled.
Mr. Ryan also asked about the zombie home funds Clinton County is contributing too. Mr. McDonald stated the process is still in the early stages. Mr. McDonald and Mr. Irwin attended a meeting last week to obtain information.

Peru – At its Monday, January 28th meeting the Peru Town Board approved a proclamation designating February as Career and Technical Education Month. CV-TEC Director Michele Freedman thanked the Board and commented on the exciting CV-TEC programs, especially how much they’ve changed over the years. Today CV-TEC students can earn college credits.

Peru – The Peru Town Board accepted the resignation of Peru Youth Commission Chairperson Jennifer Madore at its Monday, January 28, 2019 meeting. Madore is the third Youth Commission member to resign over the past few months. On November 27th the Board accepted the resignations of Beth Lozier and Carrie Smith. Earlier in Monday’s meeting the Board appointed Jonathan Whitmarsh and Kirsten O’jida-Blair to the Commission.
As previously reported a town plow truck was severely damaged in a January 4th rollover accident. Both the truck and plow were determined to be beyond repair. Last night the Board approved the emergency purchase of a new plow truck at a cost not to exceed $211,000. The town expects to receive an insurance payment between $60,000 and $70,000 on the damaged truck yielding a net cost to the town of about $141,000. The purchase was deemed as an emergency purchase after Highway Superintendent Michael Farrell said that it would have to be ordered by the end of February to ensure delivery in time for the next plowing season. Otherwise, delivery would be delayed until very late in 2019 or spring 2020. The $211,000 price is in line with another plow truck recently purchased with competitive bidding.
In response to a question from the Peru Gazette, Supervisor Brandy McDonald said the Board is awaiting a proposal from Washington Street developer William Sawyer. Sawyer and the Town have a dispute centering on Sawyer’s not paving shoulders or installing 5-foot wide sidewalks.
The Gazette also asked if the Board has heard from NYS officials regarding the stalled Main Street upgrade. Supervisor McDonald said, “No, we’ve heard nothing.” The Gazette commented that perhaps it’s time to take up the matter with our New York State legislators.
The Board approved a proclamation designating February as Career and Technical Education Month. CV-TEC Director Michele Freedman thanked the Board and commented on the CV-TEC programs. She said, “I’m pleased to let you know that in Clinton and Essex County we serve over 600 high school students every year… are training in 31 career and technical programs…No longer is taking a vocational-technical course an either/or opportunity. It’s a transition or pathway to what’s next in life. Our students taking our construction trades programs, our diesel mechanics programs, our health careers programs are also earning college credits while they’re in our high school programs and transitioning into post secondary careers, associates, masters and doctorate degrees while they are still training in the field.”
The 2019 Ford Escape to be used by the Code Enforcement Officer has arrived.
Confidential Secretary Pam Barber commented that there have been a few problems with the new Logics Solutions software; nevertheless, she praised Logic’s support personnel for their persistence and availability.
In other actions the Board:
Corrected two Organizational Meeting resolutions. The correct date for the the last Board meeting of 2019 is December 30th at 6 p.m. The salary of the Water/Sewer Superintendent also needed to be corrected. The Peru Gazette will publish all the Organizational Meeting data as soon as it is made available.
Accepted the 2019 annual contract with the Peru Free Library in the amount of $80,000.
Accepted Counselor Jim Douglass’s audit of the Peru Town Court records. Counselor Douglass commented, “The Court Clerks do a great job. Everything is well-organized and well-kept.” Douglass said he was amazed by the scope of the court’s required paperwork.
Accepted a NYS Revolving Fund Short-term Financing Memo related to the upcoming sewer system upgrade.

DURHAM, NH (01/28/2019)– James Matthews of Peru has been named to the Dean’s List at the University of New Hampshire for earning High Honors for the fall 2018 semester. Matthews is majoring in Theatre:Musical Theatre.

Assemblyman Billy Jones (D-Chateaugay) announced that legislation he co-sponsored removing the mandate that standardized test scores be used for teacher and principal evaluations has passed the Assembly (A.783).
“Test scores don’t accurately measure students’ or teachers’ worth,” Jones said. “A one-size-fits-all approach to education hurts a student’s ability to learn and a teacher’s ability to educate. By giving control back to North Country teachers and schools, we can ensure kids get a well-rounded education that truly fits their individual needs.”
The legislation changes the requirement that student scores on state-created or administered exams, including grades 3 through 8 English Language Arts (ELA) and math tests, be used to evaluate teachers and principals. This allows local school districts to adopt evaluation systems that better reflect the work educators do. Additionally, the bill ensures scores on these tests aren’t included on a student’s permanent record.
In 2016, nearly 30 percent of North Country students opted out of the standardized math exam, while approximately 25 percent refused to take the ELA assessment.[1] This legislation is a huge victory for teachers and allows them to better connect with the educational needs of their students, Jones noted.

Washington, D.C. – Congresswoman Elise Stefanik has cosponsored H.R. 367 – the Pay Our Coast Guard Parity Act of 2019. Currently, the United States Coast Guard is the only branch of the military that is having to go without pay during this government shutdown. Despite this, the USCG continues to provide support to law enforcement, Homeland Security, search and rescue missions, and more. This bill would ensure the USCG receives regular pay during any lapse in appropriations.
“It is entirely unacceptable that any branch of our military is forced to work without pay during this unnecessary government shutdown,” said Congresswoman Stefanik. “The United States Coast Guard puts their lives on the line for our safety each day, and are honorably continuing to carry out their responsibilities without compensation. I am proud to be an advocate for the USCG, specifically for the active duty Coast Guard officers in my district. Congress needs to get its act together to pay our military and end this shutdown – the longest in history.”
Congresswoman Stefanik has been a consistent vote to keep the government open since her first term in Congress. Yesterday, she cosponsored the Pay Our TSA Act, which would ensure our TSA screeners are also paid during any lapse in appropriations.
